Terms of Service
Last updated: September 22, 2026
These Terms of Service (“Terms”) explain how Daily House (“we,” “our,” or “us”) works with real estate agents, teams, and brokerages (“you”) who join our membership, and how anyone may use our website.
1. Agreement to These Terms
By using the Daily House website or joining our membership (“Services”), you agree to these Terms. If you do not agree, please do not use our Services.
2. What Daily House Does
Daily House plans, creates, and publishes personalized, hyper-local content for real estate professionals. Every membership includes all of the following Services:
- Hyper-local social content: static posts, carousels, and reels several times each week, about your market, neighborhoods, local events, current conditions, and the questions buyers and sellers are asking.
- Property campaigns: content for your listings, such as listing announcements, open-house promotions, neighborhood spotlights, nearby-attraction content, under-contract updates, and printable flyers.
- Publishing and brand management: content created in your branding and published to your social media accounts and your Google Business Profile.
- Review outreach: after a closing, emailing your client as a member of your team to make leaving a review simple.
- Testimonial content: turning positive client feedback into content for your accounts.
- Monthly newsletter: a newsletter sent to your sphere (the past clients and contacts you share with us).
Before you join, we walk you through how it all works, including which of your accounts we publish to.
3. Membership and Payment
Daily House is a month-to-month membership. There is no long-term contract. Your membership renews automatically each month until you cancel. You can cancel at any time, and cancellation takes effect at the end of your current billing period. By joining, you agree to pay the monthly fee we confirm with you before you join.
4. How Publishing Works
We plan, create, and publish your content for you. Content is not sent to you for approval before it is published. By joining, you authorize us to publish content on your behalf to the social media accounts and Google Business Profile you give us access to.
You can tell us at any time about topics, listings, or clients you do not want featured, and we will follow those instructions going forward.
5. Your Responsibilities
Because we publish without a pre-approval step, we rely on the information you give us. You are responsible for:
- Accurate listing details: including price, address, features, status (for example, active, under contract, or sold), and open-house times, and for telling us promptly when any of these change.
- Brokerage information: your brokerage’s name and any license information, disclosures, or advertising requirements that must appear in your marketing.
- Brand materials: your logo, headshot, brand colors, and any other materials you provide, and having the right to let us use them, including listing photos.
- Account access: giving us access to the accounts we publish to, and keeping that access current.
- Permission to share client contact details: before you share a client’s name, email address, or phone number with us, you are responsible for having their permission to share it with us and for us to contact them on your behalf about reviews and your newsletter.
6. Corrections and Takedowns
If something we published needs fixing (for example, a wrong price, a listing that has sold, or a detail that is out of date), tell us through the chat on our website or by booking a call, and we will correct it or take it down right away.
You can also remove or hide any post from your own accounts at any time. We may correct or remove content on our own if we learn it is inaccurate or breaks a platform’s rules.
7. Content Accuracy
We prepare content using the information you provide and publicly available sources, and we include the brokerage information and disclosures you give us. While we strive for accuracy, we are not responsible for errors that come from information provided by you or by third parties, including market data. As a licensed real estate professional, you remain responsible for meeting the licensing and advertising rules that apply to you.
8. Review Outreach, Testimonials, and Newsletters
- Review outreach: after a closing, we contact your client by email only, identifying ourselves as a member of your team, to ask whether they would leave a review. We never write reviews for anyone, and we do not offer rewards for reviews.
- Testimonials: we only turn a client’s feedback into testimonial content when the client has agreed to have it shared, and we keep their words accurate.
- Newsletters: we send your monthly newsletter only to the contacts you share with us. Every newsletter includes a way to unsubscribe, and we honor unsubscribe requests promptly.
9. Text Messages From Our Website Chat
If you give us your mobile number in the chat on our website and agree to receive text messages, we may text you: replies to your questions, help scheduling a call, and follow-ups about your inquiry, plus occasional updates and offers if you agreed to promotional messages. Message frequency varies, and message and data rates may apply. Reply HELP for help, or STOP at any time to stop receiving texts. Agreeing to texts is not a condition of any purchase. See our Privacy Policy for how we handle your number.
This applies only to people who opt in through our website chat. We do not text members’ clients: review outreach and newsletters are sent by email only.
10. Intellectual Property
All content Daily House creates for your account, including designs, graphics, captions, newsletters, and brand assets, becomes your property once you have paid for the applicable billing period. We may show this work in our portfolio unless you ask us not to in writing.
11. Limitation of Liability
Daily House is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our Services. Our total liability for any claim arising from the Services will not exceed the amount you paid us in the month before the claim.
12. Ending Your Membership
Either of us may end your membership at any time. When it ends, we stop creating and publishing content, stop review outreach, and stop sending your newsletter. Content already published stays on your accounts, which you control. We may suspend or end the Services if these Terms are violated or if we believe the Services are being used in a way that is harmful to others or to our business.
13. Changes to These Terms
We may update these Terms from time to time. We will notify members of material changes, and the “Last updated” date at the top will change. Continuing to use the Services after an update means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules.
